I have chosen to be a non-litigation attorney, dedicating my practice to helping families deal with the problems of life, especially the passing of the torch from one generation to the next. I personally know what it is to lose a parent or spouse. I know I can help because I understand in both my heart and my brain. I believe that the most important job I can do is to keep families in control. One of the worst things that can happen is to have one's most personal decisions made by outsiders, i.e. courts. We need courts only if we need family umpires. Absent that, we want to stay out of court, if at all possible. That is why I have drafted the most powerful documents I have seen to keep decisions out of court. Routinely, all trusts are supervised and controlled by a probate judge, with potentially significant cost and hassle-but not with a Living Trust. I recommend to most, but not all, clients that a Living Trust be created to hold children's shares as long as the trustee thinks necessary, without those annual probate accountings.
