Getting married in Florida

IMPORTANT NOTE: Marriage laws and license requirements change continually, so please check the latest information with your local marriage license bureau office or county clerk's office before making your wedding or travel plans, and before inviting your guests.

Who may apply for a marriage license

You do not need to be a Florida resident to marry in Florida.

Applicants must be 18 years old to apply for a marriage license. For persons under 18, please contact the County Clerk’s Office in your county for further information.

Cousin marriages are permitted in Florida.

ID requirements

A couple wishing to be married must be prepared to provide their Social Security numbers or any other available identification numbers, such as driver license numbers or other photo IDs (passport, military ID) to the Clerk’s office to apply for a marriage license.

Previous marriages

If either applicant has been previously married, the exact date of divorce, death or annulment must be presented as well as the state and county where the divorce took place.

Blood tests and other tests

No blood tests or examinations are required.

Marriage ceremonies and witnesses

Many County Clerks in Florida perform civil marriage ceremonies in their offices. For further information regarding civil marriage ceremonies, please contact the County Clerk’s Office directly to see if they provide this service.

There is space on the marriage certificate for two witnesses to sign, but this is not required by law.

Officiants

Any ordained church ministers or clergy, all judicial officers, including retired judicial officers, clerks of the circuit courts, and notaries public.

Fees

The fee for a marriage license is $93.50. The fee is reduced to $61 if both parties are Florida residents and have provided proof of a premarital class with a certified provider (see “Premarital preparation course” above).

Waiting period

The waiting period is waived for Florida residents that have both completed a state approved premarital preparation course within the last year (see below). There is a 3 day waiting period for Florida residents who have not taken the course. There is no waiting period for non-Florida residents.

Premarital preparation course

To receive a waiver of the three-day waiting period, if one or both parties are a Florida resident, the couple must complete a four hour premarital preparation course within one year prior to obtaining a marriage license and a valid certificate of completion must be presented to the Clerk's office. A list of approved course providers can be obtained from your local county clerk.

Validity of license

After the court issues the marriage license, the license is valid for 60 days.

Other requirements

Applicants for a marriage license are required to read a Marriage Handbook and affirm that they have read it.

Copy of marriage certificate

After the ceremony is preformed the marriage license must be sent or brought to the court, which is usually done by the person who performed the ceremony. It will then be recorded in the Official Records and an official copy sent to the new couple.
