Getting married in Indiana

IMPORTANT NOTE: Marriage laws and license requirements change continually, so please check the latest information with your local marriage license bureau office or county clerk's office before making your wedding or travel plans, and before inviting your guests.

Both applicants must appear at the Clerk's Office in person to complete the application. However, they may come at different times. If necessary requirements are not met on the same day, the application may be held for no longer than sixty (60) days, after which time, it will be voided.

Indiana residents must obtain a license in the county in which at least one of them resides. For example, if the bride lives in Marion County and the groom lives in Hamilton County, the couple can apply for their marriage license in Marion OR Hamilton county.

Proof of residency is required.

Out of state residents must obtain a marriage license in the county in which the marriage will be performed. Both applicants must apply for their license in person.

Who may apply for a marriage license

If you are under 18, a certified copy of your birth certificate is required. If you are 17 years old you must apply for the license with both parents (or the person with legal custody). They will need to sign the consent portion of the application.

If you are 16 or 15 years old, you must petition the Circuit Court via a "Permission to Marry" form. The cost for filing this petition is $120.00 even if the Judge refuses to allow the couple to marry.

Cousin marriages are permitted when both individuals are at least sixty-five (65) years of age.

ID requirements

Applicants aged 18 or older must show one of the following forms of identification at the time of application: a valid driver's license, current state-issued identification card, original certified birth certificate, baptismal certificate with date of birth, military identification, passport, life insurance policy with date of birth, school identification card, or transcripts of school records indicating date of birth.

Applicants under the age of 18 must have an original certified copy of their birth certificate.

Previous marriages

If either applicant has been married previously, the license application requires information on the month, year and manner (e.g., divorce, death, annulment) in which the marriage ended. If either applicant has been divorced for less than 60 days, a copy of the divorce decree must be provided.

Blood tests and other tests

No blood tests are required.

Marriage ceremonies and witnesses

The marriage ceremony can be held in the venue of your choice.

No witnesses are required.

Officiants

Marriages may be performed by a member of the clergy (including a minister, priest, bishop, rabbi, and imam), a judge, a mayor in his or her own county, a magistrate, a clerk of the circuit court, a clerk or clerk-treasurer of a city or town, the Friends Church, the German Baptists, or the Bahai faith.

Fees

Indiana residents: $18; residents of other states/countries: $60. Personal checks are not accepted.

Waiting period

Marriage licenses can be issued on the same day of application. There is no legal waiting period to obtain a marriage license.

Validity of license

Once issued, a marriage license is valid for sixty (60) days during which time the marriage must be performed. The license can only be used within the State of Indiana.
