Getting married in Kansas

IMPORTANT NOTE: Marriage laws and license requirements change continually, so please check the latest information with your local marriage license bureau office or county clerk's office before making your wedding or travel plans, and before inviting your guests.

To get a marriage license you must file and application and pay the license fee at the Office of the Clerk of Court in any district court in Kansas.

The applicant must be the bride or groom. Both applicants need not be present.

Applicant must swear under oath: The applicants are not related (i.e. 1st cousin or closer); the applicants have no spouse (if divorced, decree must be filed over 30 days previous); the applicants know of no other reason why they should not be legally married.

Who may apply for a marriage license

You do not have to be a resident of Kansas.

Any applicant who is under age 18 must have either notarized, written consent of all then living parents and legal guardians OR notarized, written consent of one parent or legal guardian and consent of a district court judge; identification number (usually social security number).

Cousin marriages are not permitted.

Common-law marriage

Common-law marriage is legal in Kansas. For a man and woman to form a common-law marriage, they must: (1) have the mental capacity to marry; (2) agree to be married at the present time; and (3) represent to the public that they are married.

ID requirements

A certified Birth Certificate. Full name (First, Middle and Last); Residence (City, county and state); Birthplace (State or foreign country); Date of birth; Race; Highest level of education completed; Both applicants fathers' full name (First, Middle and Last); Both applicants mothers' full name (First, Middle and Maiden); All birthplaces (State or Foreign Country); Name and address of person performing ceremony, if known.

Previous marriages

If either applicant has been married previously, they must show how their last marriage ended and when, and the number of this marriage (1st, 2nd, etc).

Blood tests and other tests

No blood test is required.

Marriage ceremonies and witnesses

Marriage may be validly solemnized and contracted in Iowa, after a license has been issued for the marriage, in the following manner: by the mutual declarations of the two parties to be joined in marriage, made before an authorized officiating person and in the presence of at least two competent witnesses over 18 years of age, other than the officiating person, that they take each other as husband and wife.

Officiants

The following are authorized to be officiating persons: Any currently ordained clergyman or religious authority of any religious denomination or society; any licentiate of a denominational body or an appointee of any bishop serving as the regular clergyman of any church of the denomination to which the licentiate or appointee belongs, if not restrained from so doing by the discipline of that church or denomination; any judge or justice of a court of record; any municipal judge of a city of this state; and any retired judge or justice of a court of record.

Ministers are required to file credentials or ordination with the judge of a probate court before performing marriages. Minister must return the marriage license and a certificate of marriage to the probate judge who issued the marriage license within 10 days after the marriage.

The two parties themselves, by mutual declarations that they take each other as husband and wife, in accordance with the customs, rules and regulations of any religious society, denomination or sect to which either of the parties belong, may be married without an authorized officiating person.

Fees

$50 fee and a $25 judicial branch surcharge payable in cash or money order only. Money orders should be payable to "Clerk of the District Court". The money is non-refundable.

Waiting period

3 business days.

Validity of license

The marriage license is valid for 6 months, and can only be used within the State of Kansas.

Copy of marriage certificate

Completed marriage licenses are first filed with the County Clerk of the District Court in the county where the marriage license was issued. The District Courts then forward the completed licenses once a month to the Office of Vital Statistics. Certified copies from this office are usually available by the second month after the marriage takes place.
