Getting married in Minnesota

IMPORTANT NOTE: Marriage laws and license requirements change continually, so please check the latest information with your local marriage license bureau office or county clerk's office before making your wedding or travel plans, and before inviting your guests.

You can apply for a Minnesota marriage license at any county Registrar in Minnesota (see list in “For more information” below) and then use it in any county in Minnesota.

The two of you go together to the County Registrar, both of you show your driver's licenses, you fill out the form, you pay the fee, and then the county will mail you the license after the 5-day waiting period.

Note: In Hennepin County, both the bride and groom must apply for their Minnesota marriage license together, but in other counties, either person can apply alone.

Who may apply for a marriage license

You do not have to be a Minnesota resident to get a Minnesota marriage license.

If either applicant is under 18 you may need a parent to come with you.

Cousin marriages are not permitted, unless the aboriginal culture of the couple permits cousin marriages.

ID requirements

All you need is your ID, usually your driver's license.

Previous marriages

If you've been divorced, you'll need a copy of a divorce decree and be ready to list the date, county and state of the divorce.

If you are a widow or widower, you need the date of the death of your spouse, but no paperwork is needed.

Blood tests and other tests

No, a blood test is not required in the state of Minnesota.

Marriage ceremonies and witnesses

Bring your license on your wedding day to be signed by the officiant and two witnesses aged 16 or over.

Officiants

You may choose to have a marriage ceremony performed by anyone authorized by law to provide the service. Several judges in this county provide this service.

Ministers of any religious denomination may also perform the marriage ceremony if they have filed a copy of their ministerial credentials with a court administrator in the state.

Fees

$115.00 or $40.00 for couples who have completed at least 12 hours of premarital education. In order to qualify for the reduced fee, the parties must submit a signed, notarized, and dated statement on their letterhead from the person who provided the premarital education confirming it was received. The statement must be presented at the time of application to qualify for the reduced fee. The premarital education must be provided by a licensed or ordained minister or the minister’s designee, a person authorized to solemnize marriages under section 517.18, or a person authorized to practice marriage and family therapy under section 148B.33. The education must include the use of a premarital inventory and the teaching of communication and conflict management skills.

Waiting period

You will receive your Minnesota marriage license 5 days after you apply (the "waiting period"), plus time for the check to clear, plus the time in the mail.

The exception is Hennepin County. Instead of mailing you your Minnesota marriage license, Hennepin County gives the license to you immediately, but it is not valid until after a 5-day waiting period.

Once you receive the Minnesota marriage license, you may have your wedding immediately. Just make sure to bring your license to the wedding ceremony.

If you can't wait the 5 days, you may be able to arrange a hearing with a judge who can grant a waiver, and then receive the license the same day. Call the Clerk of Court for hearing times.

If one of the applicants has a criminal felony conviction, the waiting period is 30 days, instead of the usual 5-day waiting period.

Validity of license

The marriage license expires 6 months after it is issued.

The license can only be used within the State of Minnesota.
